Welcome to the website of New Image Restoration ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of our website at newimage-restoration.com and the restoration services we provide. By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

1. Services Overview

New Image Restoration provides fire, water, mold, flood, and storm damage restoration services for residential and commercial properties throughout the greater Philadelphia region, including Delaware County, Montgomery County, Bucks County, Chester County, South Jersey, and Northern Delaware. Our services include, but are not limited to, water extraction, structural drying, fire and smoke damage repair, mold remediation, demolition, debris removal, and disaster cleaning.

2. Service Agreements

All restoration work performed by New Image Restoration is governed by a written service agreement or work authorization signed by the property owner or their authorized representative prior to the commencement of work. These Terms supplement, but do not replace, any written service agreement.

  • Estimates provided by New Image Restoration are based on visible damage at the time of inspection. Hidden or secondary damage discovered during the restoration process may result in revised scopes and costs, which will be communicated to you before additional work begins.
  • A signed work authorization is required before any work begins, except in cases where emergency mitigation is necessary to prevent further property damage (see Section 5).
  • All work is performed in accordance with IICRC (Institute of Inspection, Cleaning and Restoration Certification) standards and applicable local, state, and federal regulations.

3. Insurance Claims Assistance

New Image Restoration works with all major insurance companies and provides insurance claims assistance as a courtesy to our customers. It is important to understand the following:

  • We are not an insurance company, insurance broker, public adjuster, or legal advisor. Our claims assistance is limited to documenting damage, providing cost estimates, communicating with adjusters, and submitting supporting documentation on your behalf.
  • We do not guarantee insurance coverage, claim approval, or any specific claim outcome. Coverage determinations are made solely by your insurance carrier in accordance with your policy terms.
  • You remain responsible for understanding your insurance policy, including deductibles, coverage limits, and exclusions. We strongly encourage you to contact your insurance agent directly for questions about your coverage.
  • Regardless of insurance claim status or outcome, the property owner is ultimately responsible for payment of all services rendered by New Image Restoration.
  • Our claims assistance services are not a substitute for professional legal or insurance advice. If you have a dispute with your insurer, we recommend consulting a licensed public adjuster or attorney.

4. Property Access Authorization

By signing a work authorization or requesting our services, you grant New Image Restoration and our authorized employees, agents, and subcontractors permission to access the designated property to perform inspections, assessments, restoration work, and follow-up visits as necessary. You represent and warrant that you are the property owner or have legal authority to grant such access. If you are a tenant, you represent that you have obtained authorization from the property owner. We are not responsible for any disputes between tenants and property owners regarding authorization.

5. Emergency Services

New Image Restoration provides 24/7 emergency restoration services. The following terms apply specifically to emergency situations:

  • Emergency mitigation: In situations where immediate action is required to prevent further property damage (such as water extraction, board-up, or tarping), we may begin emergency mitigation work before a full estimate or written authorization is completed, with verbal or electronic consent from the property owner or authorized representative.
  • Response times: While we strive to respond to emergencies within 60 minutes, response times may vary based on factors including weather conditions, distance, demand, and the nature of the emergency. Response time estimates are not guarantees.
  • Scope of emergency work: Emergency mitigation is focused on preventing further damage and stabilizing the property. Full restoration work is performed under a separate scope and estimate.
  • After-hours service: Emergency services are available 24 hours a day, 7 days a week, 365 days a year. Non-emergency consultations, estimates, and scheduled work are generally conducted during normal business hours unless otherwise arranged.

6. Payment Terms

  • Payment terms are specified in your written service agreement. Unless otherwise agreed in writing, payment is due upon completion of work.
  • For insurance-covered jobs, we will work directly with your insurance carrier. However, you are responsible for any deductibles, non-covered items, and any balance not paid by your insurer.
  • We accept payment by check, credit card, ACH transfer, and other methods as specified in your service agreement.
  • Late payments may be subject to interest charges and collection fees as permitted by applicable law and specified in your service agreement.

7. Limitation of Liability

To the fullest extent permitted by law:

  • New Image Restoration shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to our services or your use of this website, including but not limited to loss of profits, loss of use, business interruption, or loss of data.
  • Our total liability for any claim arising from our services shall not exceed the total amount paid by you for the specific service giving rise to the claim.
  • We are not liable for delays, failures, or damage caused by events beyond our reasonable control, including natural disasters, severe weather, utility failures, government actions, supply chain disruptions, or other force majeure events.
  • We are not responsible for pre-existing conditions, structural deficiencies, or hidden damage that was not identified during the initial inspection and was not caused by our work.
  • Restoration work cannot guarantee that a property will be returned to a condition identical to its pre-loss state in every respect. We restore to industry-standard pre-loss condition as defined by IICRC guidelines.

8. Warranties

New Image Restoration stands behind the quality of our work. Specific warranty terms, if applicable, will be outlined in your written service agreement. Warranties cover workmanship defects and do not cover damage resulting from subsequent events (such as new water intrusion, fire, or natural disasters), normal wear and tear, or customer modifications to completed work.

Your use of this website is subject to the following terms:

  • All content on this website, including text, images, logos, and graphics, is the property of New Image Restoration and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission.

You agree to indemnify and hold harmless New Image Restoration, its owners, employees, agents, and subcontractors from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from your breach of these Terms, your misuse of our website, or your provision of inaccurate information (including false representations of property ownership or authorization to access a property).

11. Dispute Resolution

Any disputes arising from these Terms or our services shall be governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. You agree that any legal action shall be brought exclusively in the state or federal courts located in Delaware County, Pennsylvania. Before initiating any legal proceedings, both parties agree to make a good-faith effort to resolve disputes through direct communication.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

13. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes take effect immediately upon posting to this page. The "Last updated" date at the top of this page indicates when the Terms were most recently revised. Your continued use of our website or services after any changes constitutes acceptance of the updated Terms.
